4. Payment and Refund Policy
Payments for our services are processed through Stripe and PayPal. All payments are final, and Castella Media Group does not offer refunds or money-back guarantees. Please review your selections thoroughly before completing your payment.
5. Intellectual Property Rights
All content provided by Castella Media Group, including text, graphics, logos, and images, is protected by copyright and intellectual property laws. Unauthorized use of our content without written consent is strictly prohibited.
6. User Conduct
Users are prohibited from harassing or stalking influencers and other individuals involved in our campaigns. Castella Media Group reserves the right to terminate services for users who violate this policy.
7. Dispute Resolution
In the event of a dispute arising from or related to these terms or our services, both parties agree to resolve the matter through final and binding arbitration, rather than through court proceedings.
8. Amendments to Terms
We reserve the right to amend these terms at any time. All changes will be posted on our website. Your continued use of our services after changes are posted constitutes your acceptance of the updated terms.

11. Termination
Castella Media Group reserves the right to terminate or suspend access to our services at any time, without prior notice or liability, for any reason, including breach of these Terms of Service.
12. General Provisions
These Terms of Service constitute the entire agreement between the user and Castella Media Group regarding the use of our services. The failure to enforce any provision of these terms shall not constitute a waiver of that provision.
13. Non-Solicitation & Non-Circumvention
Clients are prohibited from directly contacting, soliciting, recruiting, or hiring any influencer, content creator, or talent that was introduced to them, assigned to their campaign, or made known to them through Castella Media Group's services.
This restriction applies during the active campaign period and for a period of twelve (12) months following the conclusion of the campaign.
If a client is found to have circumvented Castella Media Group by engaging our influencers or talent outside of our platform, we reserve the right to immediately terminate the relationship, refuse future service, and pursue damages equal to the fees that would have been owed had the engagement been conducted through Castella Media Group.
This provision applies to the client, their employees, contractors, affiliates, and any related third parties acting on their behalf.
14. Confidentiality
All information related to Castella Media Group's influencer network, including but not limited to influencer identities, contact information, pricing, rates, campaign strategies, and performance data, is considered confidential and proprietary. Clients may not disclose, share, reproduce, or distribute any confidential information to third parties without prior written consent from Castella Media Group. This obligation survives the termination of any campaign or business relationship.
15. Campaign Results & No Guarantees
Castella Media Group does not guarantee specific results from any campaign, including but not limited to views, impressions, engagement, follower growth, streams, or sales. Performance metrics shared during the sales process or campaign planning are estimates based on historical data and are not binding commitments. Campaign performance may vary based on factors outside of Castella Media Group's control, including platform algorithms, content quality, and audience behavior.
16. Client Content Responsibility
Clients are solely responsible for ensuring they own or have obtained all necessary rights, licenses, and permissions for any content submitted to Castella Media Group, including but not limited to music, videos, images, trademarks, and logos. Castella Media Group is not liable for any copyright, trademark, or intellectual property disputes arising from content provided by the client. By submitting content, the client grants Castella Media Group a non-exclusive license to use, distribute, and display the content solely for the purpose of executing the campaign.
17. Right to Refuse Service
Castella Media Group reserves the right to decline or refuse service to any individual or entity at its sole discretion, with or without cause, at any point before or during a campaign. In the event service is refused before a campaign begins, any payments made will be refunded in full.
18. Limitation of Liability
To the maximum extent permitted by law, Castella Media Group's total liability for any claim arising from or related to our services shall not exceed the total amount paid by the client for the specific service giving rise to the claim. Castella Media Group shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to lost profits, lost revenue, or lost business opportunities.
19. Indemnification
The client agrees to indemnify, defend, and hold harmless Castella Media Group, its owners, employees, contractors, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses, including reasonable attorney's fees, arising out of or related to the client's use of our services, content provided by the client, the client's breach of these Terms of Service, or any third-party claims resulting from the client's actions or content.
20. Governing Law & Jurisdiction
These Terms of Service and any disputes arising from or related to them or the use of our services shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law principles. Any legal proceedings not subject to the arbitration provision in Section 7 shall be brought exclusively in the state or federal courts located in Montgomery County, Pennsylvania, and both parties consent to the personal jurisdiction of such courts.
21. Force Majeure
Castella Media Group shall not be held liable for any delay or failure to perform its obligations under these Terms of Service when such delay or failure results from circumstances beyond its reasonable control. This includes, but is not limited to, platform outages, changes to platform policies or algorithms, government actions or regulations, platform bans or restrictions, natural disasters, acts of war or terrorism, pandemics, internet or infrastructure disruptions, and actions taken by third-party service providers. In such events, Castella Media Group will make reasonable efforts to resume services as soon as practicable but shall not be obligated to issue refunds for any resulting delays or interruptions.
